1. Acceptance of Terms

By creating an account or using Bigger Than Pain, you agree to these Terms & Conditions. If you do not agree, do not use the service. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Service Description

Bigger Than Pain is a digital self-management tool for people living with persistent pain. The service includes pain and mood tracking, AI-assisted coaching conversations, guided movement plans, breathing and regulation exercises, and educational content. The service is delivered as a progressive web application (PWA).

3. Health Disclaimer

Bigger Than Pain is not a medical device and does not provide medical advice, diagnosis, or treatment. The service is designed to support self-management alongside professional healthcare, not replace it. AI coaching responses are generated by artificial intelligence informed by pain science principles - they are not from a healthcare professional. Always consult your doctor or physiotherapist for medical decisions. If you are experiencing a medical emergency, call emergency services immediately.

Where BTP is used alongside care from David McGettigan Clinic (see §11), your clinician uses BTP-derived signals to inform clinical decisions. The signals supplement but do not replace clinical judgement. BTP itself remains a self-management tool, not a medical device, in the integrated context as in standalone use.

4. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must provide accurate information during registration. You must not share your account with others or use the service for any unlawful purpose. We reserve the right to suspend or terminate accounts that violate these terms.

5. Subscription & Billing

Certain features of Bigger Than Pain require a paid subscription. Subscriptions are billed monthly through Stripe. By subscribing, you authorise recurring charges to your payment method. Prices are displayed before purchase and may change with notice. Free trial periods, if offered, convert to paid subscriptions unless cancelled before the trial ends.

6. Cancellation & Refunds

You may cancel your subscription at any time through the Stripe Customer Portal accessible from your Profile settings. Upon cancellation, you retain access until the end of your current billing period.

14-day cooling-off period (EU/UK consumers). Under the EU Consumer Rights Directive 2011/83/EU you have the right to withdraw from your subscription within 14 days of the initial payment, for any reason. Bigger Than Pain is a continuously-delivered digital service, so no exception to this right applies. To exercise it, email support@biggerthanpain.com within the 14-day window with your refund request. We will process a full refund via Stripe within 14 days of receiving your notice and cancel your subscription so you are not billed again.

Outside the cooling-off window, refunds are at our discretion - contact support and we'll review your situation.

7. Intellectual Property

All content, features, and functionality of Bigger Than Pain - including text, graphics, design, and software - are owned by Bigger Than Pain and protected by intellectual property laws. You retain ownership of data you enter into the service. You may not copy, modify, distribute, or reverse-engineer any part of the service.

8. Limitation of Liability

Bigger Than Pain is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

9. Governing Law

These terms are governed by the laws of Ireland. Any disputes will be resolved in the courts of Ireland.

11. Clinic-client integration (if applicable)

If you are a patient at David McGettigan Clinic (Dublin or Monaghan), your BTP account may be linked to your clinic patient record to enable integrated care. The Privacy Policy describes what that link is, what data flows, and how to control or undo it.

The clinic relationship is governed by your separate consent and care agreement with the clinic - not by these Terms. Your BTP account remains optional even if you are a clinic patient; you can use BTP without being linked.

The Health Disclaimer (§3) still applies in the integrated context. The AI-generated coaching in BTP is not a substitute for in-clinic care. Your clinician (David) interprets and acts on BTP-derived signals; BTP itself does not deliver clinical care.

Termination: closing your BTP account does not terminate your clinical relationship with the clinic. Likewise, ending your clinic care does not affect your BTP account. To make changes to your clinical record at the clinic, contact david@davidmcgettiganclinic.com directly.
